13-year-old rape victim became pregnant, the court grants permission to terminate pregnancy

These days the crime against minor girl are increasing day by day. Although Abortion is increasing in certain cases but in some cases government grant permission to abort the child. In a yet another shock the Uttarakhand court has allowed a 13-year-old rape survivor to terminate her 25 weeks of pregnancy. The order was passed on Wednesday by the bench of senior judge Sanjay Mishra.

In the case the abortion will be done under the supervision of the medical board, the court said and issued instructions to form a team of specialist doctors. The father of the rape victim had filed a petition in the high court seeking directions to the Dehradun chief medical officer and the Doon Hospital for an optimum procedure. The minor girl had also been granted permission for the procedure.

The Delhi High Court and the Supreme Court permitted abortion in such cases and the Medical Termination of Pregnancy Act of 1971, the Uttarakhand High Court allowed the girl to terminate her 25-week pregnancy as she was a minor and an unwanted pregnancy could be harmful to her mental growth. The next hearing in the case has been fixed for December 9 for checking the progress in the matter.

This is not the first case earlier in a similar case the Delhi High Court on Tuesday said the “ultimate decision” in matters of abortion ought to recognize a woman's choice to give birth and the possibility of a dignified life of the unborn child while allowing a 26-year-old married woman to undergo medical termination of her 33-week pregnancy while the right of a pregnant woman to terminate her pregnancy has been the subject matter of debate across the world.
