New Delhi: Lawyer and BJP leader Ashwini Upadhyay has moved the Delhi High Court seeking a uniform law (Uniform Religious Place Code) for charitable trusts and religious institutions of all religions. The petition filed in the High Court has challenged the legality of Sections 4, 5, 6, 7, 8, 9 of the Wakf Act, 1995, seeking to create a uniform law (Uniform Religious Place Code) for charitable trusts and religious institutions of all religions. The petition filed in the court said that these sections of the law give special status to wakf property while other trusts, monasteries, akharas and other institutions do not enjoy such status. At the same time, the petition said that the Wakf Act gives the unlimited right to the Wakf Board to declare any property as Wakf property. In his petition, Ashwini Upadhyay has said that Hindu, Jain, Buddhist, Sikh, and other communities have no remedy to protect their properties from being included in the list of wakf properties by the government or the Wakf Board. Therefore, these provisions are biased against other religions, which is a violation of the right to equality enshrined in Articles 14 and 15 of the Constitution.
