No relief to AAP MP Sanjay Singh from Allahabad High Court, know the matter

Lucknow: The Lucknow bench of the Allahabad High Court rejected the plea of senior Aam Aadmi Party (AAP) leader and Rajya Sabha MP Sanjay Singh to stop the summons issued by the MP-MLA court of Lucknow on December 4 is rejected. The court said that the MP-MLA court has not committed any legal error in taking cognizance of the charge sheet submitted against them (Sanjay Singh).

This order was passed by a single bench of Justice Rakesh Srivastava on a petition filed on behalf of Sanjay Singh. The order was passed on 21 January, which was uploaded on the court website on 1 February. Singh had challenged the MP-MLA court's order passed on December 4, saying that the said order is not law friendly, as the state government's order for sanction of prosecution is not legal.

Opposing the petition, the government advocate Vimal Shrivastava had argued that mere writing of 197 in place of CRPC Section-196 in the Appropriation Sanction Order cannot make the entire process ineffective. The High Court accepted the argument of the government advocate and turned down Sanjay Singh's petition. Explain that on 12 August 2020, MP Singh said in a press conference in Lucknow that this government supports a particular caste. After that, an FIR was lodged against him under the relevant sections of the Indian Penal Code at Hazratganj police station.
