Srinagar: CPI(M) leader MY Tarigami, the spokesperson for the Gupkar Alliance, stated on Thursday that various stakeholders from political parties and civil society are contemplating filing a review petition against the Supreme Court verdict on Article 370 before January 11. On December 11, a five-judge Constitution bench of the Supreme Court had upheld the Centre's decision to abrogate Article 370 of the Constitution through a presidential order issued on August 5, 2019. Addressing the media, Tarigami said, "The doors are open. Why should we think that doors will not open for us? Earlier, when we had approached the Supreme Court challenging the Centre's decision to abrogate Article 370, many people were pessimistic and discouraged us." He added, "But, as a student of politics and a citizen of this country, an option still remains to file a review petition. Some retired judges, who are his colleagues, also feel that there is a place for a review petition before the apex court. Why should we not look for opportunities and why should we be pessimistic before taking action?" Tarigami emphasized that many people like him were seriously considering filing a review petition. He stated that many others are serious on this question because as citizens, they think that they have not got justice. "We have to explore all options, and a review petition is one of them," he remarked. He reminded that the last time the National Conference, Sajjad Lone, and leaders from Jammu, various stakeholders like Radha Kumar, and retired Air Vice Marshal Kapil Kak had filed petitions before the Supreme Court. When asked when the review petition would be filed, he replied, "We have definite time (till January 11), and we will do it (by then)." He said that the abrogation of Article 370 was a grave injustice and an attack on the basic constitutional rights of the people of Jammu and Kashmir and Ladakh. While a five-judge constitutional bench of the Supreme Court delivered the verdict after 16 consecutive days of hearing in August-September, Tarigami felt that justice was not served to the people of Jammu and Kashmir and Ladakh. "The people of Jammu, Kashmir and Ladakh have not got justice, and hence we are holding debates and discussions among various stakeholders and petitioners to file a review petition," he said. He further said that they will appeal to the Supreme Court to review their decision. "Our discussions are ongoing, and applications are being considered," he added. He also regretted that Article 370 was gradually abrogated by successive regimes at the Centre, and the democratic process was influenced by Delhi, which ultimately made Article 370 'hollow'. Referring to LG Manoj Sinha's statement that the implementation of the Anand Marriage Act in Jammu and Kashmir was possible only because of the abrogation of Article 370, Tarigami said there is a long list of amendments made to Article 370, which have made it possible to repeal the Central laws.
