'Hijab is part of freedom of expression..,' Islamic side moves SC against Karnataka HC

New Delhi: The Karnataka High Court has said that the hijab is not a compulsory practice in Islam and the ban on it will continue in educational institutions. On the other hand, the burqa side has now approached the Supreme Court. A petition has been filed in the apex court against the Karnataka High Court's verdict. The petitioner is a Muslim student who had also filed a petition in the Karnataka High Court. Islamic organisations are opposing the court's decision.

The petition filed in the Supreme Court said the Karnataka High Court was unable to understand that wearing the hijab falls under the "right to privacy," which is part of Article 21 of the Constitution. At the same time, it also says that 'freedom of conscience' is also a part of it. At the same time, the petition has said that the hijab is under "expression," saying that its protection has been given under Article 19(1)(a) of the Constitution. At the same time, former Karnataka CM BS Yeddyurappa said that the Karnataka High Court's verdict has once again proved that our Constitution is above religions and its beliefs.

At the same time, all the educational institutions in the Udupi district of Karnataka will be started from Wednesday (March 16, 2022). However, section 144 has also been imposed to avoid any nuisance during this period. The ban on processions, celebrations and demonstrations will continue till March 21. Islamic outfit Jamiat-Ulema-e-Hind has also objected to the decision, saying it will adversely affect the education and religious freedom of Muslim girls. Union Defence Minister Rajnath Singh, while advocating to welcome the decision, said students should follow the uniforms of schools and colleges. Karnataka Congress unit chief DK Shivakumar said there were concerns about education and law and order after the verdict, which was the responsibility of the BJP government in the state to keep in order.
