No anticipatory bail for accused in serious crime in UP

LUCKNOW: In a major development, people who are accused of serious crimes, like sexually harassing children or women, will no longer be able to get bail before their trial from the courts Uttar Pradesh.

In this case, the government of Yogi Adityanath has asked the state assembly to change the bill that is already on the books.

According to the proposed amendment, a person accused of a crime other than sexual assault will not be able to get anticipatory bail from the courts. This includes crimes related to the Gangster Act, the Narcotic Drugs and Psychotropic Substances (NDPS) Act, the Officials Secrets Act, and crimes that carry the death penalty.

According to the proposal, the goal of this change is to change section 438 of the CrPC about bail so that people who sexually assault women or children can't get bail.

It was done so that the people accused of these crimes couldn't change or destroy evidence or scare the victims.

In the proposal's goal, it says that, in line with the "zero tolerance" policy for crimes against women, girls, and children, it has been decided to change section 438 of the CrPC to collect organic evidence, stop evidence from being destroyed, and stop the accused from scaring the victim or eyewitnesses.

If the change is made, it will also apply to the Protection of Children from Sexual Offenses Act of 2012 (POCSO) and all parts of rape.
