According to the 2017 amendment to the Right of Children to Free and Compulsory Education (Amendment) Act, all untrained in-service teachers were required to complete this training. According to the statement, "Upon receiving a complaint regarding the matter, the Commission found that the NIOS had failed to make clear in its prospectus that the eligibility requirement for in-service graduate and post-graduate teachers to pursue a diploma in elementary education would be 50% marks in 10+2." Further, the Commission requested that the Ministry of Education reexamine the matter because it might negatively impact the right to a living for teachers who are otherwise graduates or postgraduates, who have been in the classroom for some time, and even who have earned the necessary elementary education diploma in accordance with the RTE Act and Rules enacted there under. According to a statement, "Considering the recommendations of the Commission, the Union Ministry of Education has given a one-time relaxation from this norm to all those candidates, who have cleared diploma in elementary education from the National Institute of Open School (NIOS), striking a balance between the statutory provisions and the right to life and livelihood."
