Patna: The Supreme Court on Friday gave its nod for hearing a petition filed by a judicial officer challenging his suspension by the Patna High Court. He claimed that he was sacked because of some of his decisions made swiftly, including a POCSO case. A bench of Justices UU Lalit and SR Bhatt issued notice to the Bihar government and others on a petition filed by Additional District and Sessions Judge Shashikant Rai at Araria in Bihar. Rai said in the application that he feels there is an institutional bias against him as he had completed the trial in a POSCO (Protection of Children from Sexual Offences Act) case related to the rape of a 6-year-old girl in a single day. In another case, he had sentenced a criminal to death in a 4-day trial. He claimed that these decisions were widely in the news and received appreciation from the government and the public. A bench of the apex court issued notice on the petition and sought a reply within two weeks. The bench, during the hearing, said that there are several judgements of the apex court in which it has said that the sentence should not be pronounced on the same day (after completing the hearing). In our opinion, it would be a travesty of justice that you are not giving enough notice, enough opportunity, to the person who is going to be finally sentenced to death.
