Two Congress Parliamentarians from Rajya Sabha- Pratap Singh Bajwa and Amee Harshadray Yajnik, approached the Supreme Court today challenging Vice-President M Venkaiah Naidu's dismissal of the impeachment motion against CJI Dipak Misrra.

Both the Congress MPs claimed in their petition that once the initiation of removal motion is signed by the requisite number of MPs, the Vice-President has no option but shall constitute an Inquiry Committee to investigate the allegations against the CJI Dipak Misra.

Congress leader Kapil Sibal is also likely to mention the petition against Naidu's order before Justice Chelameswar.

On April 23, Naidu, functioning in his authority as the Rajya Sabha chairman, had dismissed the notice for impeachment of CJI Misra, which was submitted by 7 Opposition parties, including the Congress.

On April 20 The notice for impeachment of CJI Misra, submitted to Naidu, was signed by 64 Rajya Sabha MPs and seven former MPs. The motion was approached on grounds of "misbehaviour".

The notice for impeachment of Chief Justice Dipak Misra had signature of MPs from the Congress, the Nationalist Congress Party (NCP), the Samajwadi Party (SP), the Bahujan Samaj Party (BSP), the Indian Union Muslim League (IUML) and the Communist Party of India and the CPI-Marxist.

 Although some of the senior Congress leaders had refrained from signing the notice for impeachment, including former Prime Minister Manmohan Singh.
