NEW DELHI:  The disqualification of 20 Aam Aadmi Party (AAP) MLAs has been dismissed by the Delhi High Court. The court said the Election Commission must hold the proceedings and consider each case by good point.

Expressing his joy, Delhi CM took his official twitter handle and said, "Truth has won. Elected representatives of Delhi were illegally disqualified. The high court has given justice to the people of Delhi," tweeted AAP chief Arvind Kejriwal, the Chief Minister of Delhi.

The banning of these lawmakers would mean by-elections in 20 seats in Delhi as AAP has 67 of Delhi's 70 seats.

The 20 lawmakers were banned because the Election Commission said they illegally held government posts. AAP says they were not permitted to present a defence. According to the provisions of office of profit, elected representatives are not permitted to hold positions in the government without specific laws that allow them to do so.

Elected lawmakers already get a salary from the regime. Additional jobs, therefore, are considered yield, since these have an added salary. AAP says the jobs - as parliamentary secretaries - carried no pay, means no law had been broken.
