Washington: The House panel looking into the attack on the US Capitol on January 6 is debating whether to suggest that three criminal counts, including insurrection, be brought against former President Donald Trump.

A person with knowledge of the situation told The Associated Press that the panel is also thinking about suggesting that prosecutors press charges for obstructing an official investigation and conspiracy to defraud the United States. 

As of late Friday, the committee was still deliberating and had not made a formal decision regarding which specific charges it would refer to the Justice Department.

On Monday, the panel will hold a public meeting at which its recommendation will be made. A source with knowledge of the situation who spoke to the AP anonymously and under the condition of anonymity confirmed the discussions. 

A second individual with knowledge of the discussions confirmed the committee was debating three charges.

It was not a surprise that referrals were made. As vice chair of the committee and a member of the nine-member panel, Rep. Liz Cheney, R-Wyoming, has been teasing the Justice Department for months about sending criminal referrals based on the substantial evidence the panel has gathered since it was established in July 2021.

Federal prosecutors ultimately decide whether to press charges, though Congress may refer criminal cases to the Justice Department.

The committee has recommended that a number of Trump associates be charged for defying congressional subpoenas during the course of its investigation.
