New Delhi: Questions have often been raised on the deaths in police encounters in the country. For the past few years, it has been claimed by the opposition parties that Uttar Pradesh has the highest number of deaths in police encounters. But the figures say a different thing. In the Lok Sabha, BJP MP Varun Gandhi asked a question about the deaths in the police encounter. After which the Minister of State for Home Nityanand Rai responded with the figures.

He has told that in 5 years, 655 criminals have died in police encounters in the country. This figure is from 1 January 2017 to 31 January 2022. The government has told that in 5 years, the highest number of deaths in police encounters in the country have occurred in Chhattisgarh. There 191 people have died. At number two is the name of Uttar Pradesh, where 117 criminals have been encounter. Let us tell you that there is no mention of encounter anywhere in the constitution. There is also no provision in the law to justify the encounter, but there are some such rules, which give the police the right to attack the criminals and justify the death of the criminal during this time.

According to Section 46 of the CrPC, if a criminal tries to save himself from arrest or tries to escape from the custody of the police or attacks the police, then in such a situation the police can also retaliate. The Supreme Court has laid down some guidelines for the investigation of death in police encounter or firing. According to this, an FIR should be registered immediately in such a case and it is mandatory to get it investigated by the team of CID or other police station. As per the apex court's guideline, there should be a magisterial inquiry into every death in police firing. It is necessary to inform the National Human Rights Commission or the State Human Rights Commission without delay in such cases.

Along with this, there are also some guidelines of the National Human Rights Commission. It has been said in these that it is necessary to give information about the death caused during police action to the commission within 48 hours. A detailed report will have to be submitted after three months. It has also been said that if the police are found guilty in the investigation, then the kin of the person killed will have to provide compensation.
