In order to increase the credibility of checks as a medium of financial transactions and to help small and medium enterprises affected by check-bounce cases, the government approved the amendment in the current Negotiable Instruments Act-1881 today. 

Now the courts will be able to provide interim compensation to the victim's side. Sources said the government will make such a provision through an amendment in this law that if the courts want such cases during the hearing, then those who write the check can issue orders to pay the interim compensation to the victim. 

According to sources, the government has also proposed a provision at the appellate level that the appellant may order the appellant writing the check only to submit a part of the compensation fixed by the trial court at the time of filing an appeal.

The amendment can only be introduced in the current winter session of Parliament. Giving information about the decisions made in the Cabinet meeting, Law Minister Ravi Shankar Prasad said that the amendment has been approved for Negotiable Instruments Act-1881. Although they did not provide the details.

According to the sources, the government believes that due to lack of adequate money in the account of the check-writer or return of check without payment, small and medium units have a lot of trouble and a big loss of business in the pending period. It is understood that the Government wants to make an amendment in Negotiable Instruments Act 1881 on the basis of suggestions from the general and business community about this and make provision for interim compensation in both the trial and appeal cases for the victim. 

A general complaint before the government is that the people of the unscrupulous type of people adopt check bounces to delay the payment. If the check is bounced, the victim has to pay a lot of money and time in the courts to get her money.

According to sources, the government is making such amendment in the relevant law that if the courts want, then the court may order an interim payment during the hearing. If the check writer is acquitted of the lawsuit, then the other party will have to refund the interim compensation amount. Similarly, the Appellate Court will also be able to order a part of the compensation fixed by the lower court while filing the case. Sources said that this will increase the credibility of the check as a medium of payment, and with this step, the government's plans to reduce the cash flows will also be strengthened.
