Centre Govt set with SC/ST ordinance if Supreme Court refuses to review

NEW DELHI: The Center government is all set with a draft ordinance to bring back all provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. This ordinance would also include return of automatic arrest for offences under the law. Govt is also going to plead with the Supreme Court to reassess its verdict.

The Centre is putting demanding efforts in the course of a review petition to cancel out the recent SC verdict doing away with obligatory arrest and setting out consent of a superior authority before the arrest of a government official. But it has also prepared its reaction if the SC does not paid attention to its arguments.

The SC ruling has made it obligatory for a preliminary investigation by a deputy superintendent of police before filing an FIR under the Act to guard against mishandling and in view of the large number of release. The court had spelled out that there was no need to wait for an investigation in case of an IPC offence.

 As per Official sources the government would stay for the court’s direction on its review petition pending in top court. “Once the court takes a decision, we will accordingly decide if it is necessary to bring in an ordinance to restore the key provisions of the SC/ST Act,” a law ministry source stated.
