US implemented changes to its visa policy according to which H-1B applicants are unlikely to get second opportunity to prove their eligibility if their application gets rejects. It is a big decision which might be unfavourable for all the H-1B visa aspirants.US gave power to its officials to turn down the visa in case applicant fails to meet the visa policy for the first time. This new rule would come in enforce from September 11.

 

Before the introduction of this policy, the official had no power to reject the visa of applicants without giving them more chance to prove their eligibility by showing more evidence. If the official rejects the application then applicants had to stay in the US for months or forced to go back to their country.  After the enforcement of this policy, if an applicant fails to meet the eligibility criteria for the first time then he has to remain in the US until the final decision of immigration judge and that too without any job.

This rule would surely affect the Indian techies. They have to be very alert while submitting their first application of H-1B visa. If an applicant leaves, then he might face the ten-year ban on re-entry to the US.
