The hearing is still going on in the Supreme Court on the demand of cancellation of section 377 of the constitution bringing homosexuality under criminal law. A five-judge bench is hearing the debate going on Tuesday. On behalf of the government, Assistant General Counsel Tushar Mehta said in the Supreme Court that the Center wants the court to decide the matter of constitutionalism of section 377.

But before the hearing was stopped, the petitioner's lawyer Maneka Guruswamy said that the Supreme Court must keep the attention of the court, the Constitution and the country in the safety of the people of Lesbian, Gay, Bi-Sexual and Transgender.

She said that Section 377 denies the right to equal rights to the LGBT community and calls Section 377 arbitrary and unconstitutional. During arguments in court, Guruswamy said that homosexuality does not hinder anyone's career and growth. He said that there are many people who have passed Higher Level Competitive Examinations which include many more examinations along with IITs, Civil Services examinations.  

During the two-day trial of homosexuality, the constitutional bench of the Supreme Court has to decide whether homosexuality is a crime or not. Five judges of the Constitutional bench of the Supreme Court, besides Chief Justice Deepak Mishra, there are four more judges, including RF Nariman, AM Khanvilkar, DC Chandrachud and Indu Malhotra. 

Tushar Mehta, who was present on behalf of the Central Government, spoke about this debate that began in the afternoon. In this case, he said that the government wants the Supreme Court to take its decision in Section 377 on its own discretion. At the same time, the central government definitely said that the Supreme Court should ensure the prevention of violence and exploitation against children.
