The court has got the views of a supervisory committee including former SC judges J M Panchal and K S P Radhakrishnan, who will examine the 241 cases. A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud asked additional solicitor general Pinky Anand and petitioner's counsel Amardip Singh Bedi to assist the court in perusing the report of the two-judge committee on December 11.

"It is a highly essential matter as we have to find out whether the Special Investigation Team decision to close the cases was suitable or not. The superior committee had earlier opined that the cases may have been time bolted for the launching of fresh prosecution. Let us see if there is any component in the facts mentioned in the case files. If we find substance, we will order prosecution," the bench said.

The petitions lined by S Gurlad Singh and Manjit Singh GK had declared that the Special Investigation Team had to search 293 cases and closed 199 of them after examination. It was alleged that 42 more cases were closed after administration introductory inquiry. The main impediment before the  Special Investigation Team was finding witnesses willing to depose in these cases after a lapse of 35 years.

On August 16, a bench orientated by Justice Misra had constituted a supervisory body of two former SC judges and asked it to "scrutinise 241 matters which have been closed and express their view whether there was justification to close the cases". The court had entertained the petition by Gurlad Singh on November 15 last year. In January, it had sought a comprehensive report from the government on the steps taken by the SIT.
