Admin will no longer be responsible for objectionable messages on WhatsApp group

Kochi: In today's era, most people use WhatsApp. Along with this, people are also associated with many groups on this app, in which they share their things or other information. If you are the admin of these groups, there is a piece of relief news for you. The Kerala High Court in one of its judgements today said that if any member shares an objectionable message/picture or video on any WhatsApp group, the group admin will not be held responsible for it.

Let us know that, in the last many years, such cases have come to light, in which objectionable messages were shared by a member of a group and legal action was also taken against the admin along with him. The Kerala High Court was hearing a case in which the petitioner admin was also made an accused along with a member who shared the objectionable video in a group.

In fact, in March 2020, an obscene video was shared on a WhatsApp group called 'Friends.' In which some children were shown to be involved in sexual acts. The WhatsApp group named 'Friends' was created by the petitioner and two others were also the admins of the group, one of whom was also the accused who shared the video. In the video shared in the group, one of the accused was booked under Sections 67B(a), (b) and (d) of the Information Technology Act, 2000 and sections 13, 14 and 15 of the Protection of Children from Sexual Offences Act (POCSO). Later, the petitioner, being the admin in the case, was made an accused, after which the petitioner admin moved to the High Court.

While hearing the matter, the court cited the decisions of the Delhi and Bombay High Courts and said that the admin of any WhatsApp group has a monopoly to add or remove anyone in the group. How can the admin have control over what a member is posting in a group? The admin cannot moderate or censor a group's message.
