On a question related to Rohingyas who came from Myanmar, India's neighbouring country, the Ministry of Home Affairs said that there is a rule to send back any person who does not have a suitable document. On the question of MP Kirodi Lal Meena during the budget session, the Ministry of Home Affairs in the Upper House said that under these rules, detailed instructions have been given to all states to send Rohingya back in the year 2014 and 2019.

It was told that the order to deport Rohingya illegally living in India has been given under the deportation extradition rule. In another question related to the illegal Rohingya, the Home Ministry has said in the Rajya Sabha that the Rohingya are living in large numbers in Jammu and Kashmir, Telangana, Punjab, Haryana, Uttar Pradesh, Delhi, Rajasthan, Tamil Nadu, West Bengal, Assam, Karnataka and Kerala.

The Ministry of Home Affairs said in the Rajya Sabha that they do not have any valid documents, so clearly the number of Rohingya living illegally cannot be determined. In 2017, Union Minister of State for Home Affairs Kiran told in Ririju Parliament that the number of Rohingyas has been estimated at 40,000 and the country is trying to send them back. He also mentioned that about 16,000 of these were formally registered as refugees from UNHCR.
