The Allahabad High Court has postponed its hearing on a plea regarding the survey of the 'wazukhana' at the Gyanvapi mosque in Varanasi. The delay occurred because the Muslim side's counsel was unable to attend due to illness. Originally scheduled for July 9, the court had given the mosque management until August 14 to file a counter affidavit.
On Wednesday, an "illness slip" was submitted on behalf of the Muslim counsel, requesting an adjournment. Consequently, the court has now set August 22 for the next hearing.
The petition was filed by Rakhi Singh, one of the plaintiffs in the Shringar Gauri worship case. Singh's counsel reported that the Muslim side had not yet filed a counter affidavit.
The dispute centers around an October 21, 2023, order from the Varanasi district judge, who refused to direct the Archaeological Survey of India (ASI) to survey the 'wazukhana' area of the mosque, excluding the part claimed by Hindus as a 'shivling.' Rakhi Singh has challenged this decision, arguing that surveying the 'wazukhana' is crucial for justice.
Singh’s revision plea argues that the district judge’s decision failed to use its legal authority to order the survey. It also claims that the court wrongly excluded the protected area from the survey, even though the application had not requested an examination of this area. Additionally, the plea suggests that non-invasive survey methods, as recommended by the Supreme Court, could be used.
The ASI has already completed a scientific survey of the Gyanvapi complex and submitted its findings to the Varanasi district judge. This survey was conducted under a July 21, 2023, order to investigate whether the mosque was built over a pre-existing Hindu temple structure.
