Raipur: The Allahabad High Court has given an important decision in the matter of hospitalization and death of corona-infected patients. The court said in the order that the cause of death of a corona-infected patient may be a heart attack or any other reason, but it should be considered as a death due to corona itself. This order has been given by a division bench of Justice AR Masoodi and Justice Vikram D Chauhan while hearing the petitions of Kusumlata and others.

Along with this, it also said that after the death of corona victims, ex-gratia amount should be paid to their dependents within 30 days and if it could not be paid in a month, then the amount should be given with 9 per cent interest. The court also said that the deaths in the hospital due to corona fully meet the criterion of proof. Medical reports mentioning heart attack or any other cause cannot be seen in isolation from corona infection. Corona is an infection. This infection can affect any organ. This can lead to the death of people. Corona causes damage to the lungs and heart and a heart attack can cause death.

Heart attack has also erred in setting a 30-day deadline for death after infection. The court has ordered the government to pay Rs 25,000 each to each of the petitioners who filed this petition. The petitioners had primarily challenged Clause 12 of the Government Order dated June 1, 2021. These are the points determining the maximum limit of claims. Under this order, it was said to apply for payment of compensation in case of death within 30 days of being positive from Corona. This point was challenged in court and now the decision has come. The petitioner had argued that the purpose of this mandate is to give compensation to the family who lost their livelihood due to the Panchayat elections due to Corona. In the court, the petitioner said that the government officials believed that their parents died of the corona, but due to non-death within the stipulated time limit in clause 12 of the mandate, compensation is being denied. Now after this order, those families will get some relief, whose reason for the death of their relatives was not considered to be corona, while they were admitted to the hospital due to corona infection.
