Rampur: The Allahabad High Court on Thursday ordered the by-election to the Swar assembly seat in Rampur, which was vacated due to the cancellation of the election of Abdullah Azam, son of Samajwadi Party (SP) MP Mohammad Azam Khan. The Allahabad High Court has directed the Election Commission to start the election process immediately.
The Allahabad High Court has given this decision while hearing the petition of Shafiq Ahmed, former chairman of the Nagar Palika Parishad of Swar tehsil of Rampur. After this order of the Division Bench of Justice Shashikant Gupta and Justice Pankaj Bhatia, the way for the election of Swar assembly seat has also been cleared. After this order of the High Court, the Election Commission can now issue notifications within a week. Due to the pending case of Abdullah Azam in the top court, the Election Commission had decided not to hold elections on Swar assembly seat. However, the court has refused to accept the contention of the Election Commission and ordered the election to be held.
Allahabad High Court had rejected the election of Abdullah Azam on 16 December 2019. Bharatiya Janata Party (BJP) leader Akash Saxena of Rampur had filed a case for contesting elections on the basis of a fake birth certificate of two and two of Mohammad Azam Khan's son, which was challenged in the High Court on behalf of Azam Khan. Hearing the petition, the court rejected the election of Abdullah Azam.
