Prayagraj: Allahabad High Court has declared a person imprisoned on the charge of rape for 20 years as innocent. The court has remarked that it is very unfortunate that despite serious charges, he is serving a sentence in jail for 20 years. The state government did not consider the law of his release even after spending so many years in jail.

The appeal filed in jail has also been defective for 16 years. Its hearing came when the legal services committee's lawyer applied for a hearing on the basis of 20 years in jail. While hearing the bench of Judge J. K. Thacker and Judge Gautam Chaudhary, the person has been ordered to be released from jail immediately if the rape charge is not proved. The court has given this order, accepting the appeal of Vishnu, who lives in Lalitpur. On 16 September 2000, Vishnu was accused of raping a woman, a Scheduled Caste, who was going from home to a farm.

The court observed that the charge of rape was not proved. There was no evidence of coercion in the medical report. The victim was pregnant for 5 months. There were no such marks to say that it was forced. The report was also written by husband and father-in-law three days after the incident. On which the district court had sentenced him to 10 years on the charges of rape and life imprisonment in the crime of SC / ST Act and was imprisoned since 2000.
