Allahabad HC stays order to conduct ASI survey of Gyanvapi Masjid

Prayagraj: The Allahabad High Court on Thursday stayed the lower court's decision to conduct an ASI survey in a land dispute case related to the self-land Lord Visveswara Nath Temple and Gyanvapi Masjid in Kashi.  In fact, the Senior Division Civil Judge of Varanasi had ordered a survey of the disputed site on ASI.

The order was challenged by the Mosque's Anjuman Sanjharia Committee and the Uttar Pradesh Sunni Central Wakf Board in the High Court. Earlier, in the last hearing, the High Court reserved its verdict. The Mosque's Sanjatiya Committee and the Uttar Pradesh Sunni Central Wakf Board had moved the high court opposing the lower court's decision in Varanasi, stating that a case related to the dispute was already pending in the high court, in which case the Varanasi court had no right to pass such an order.

The petitioner in his order had said that it was a wrong order and it should be quashed. The court had reserved its verdict on August 31 after a prolonged argument. A single bench of Justice Prakash Padia gave its verdict in the afternoon. The lower court had ordered the survey to ASI saying that the order was only for surveying, while the ownership rights case was pending in the high court.
