Amul wins a 20-year-old case related to its ‘Amul Shakti’ and ‘Amul Taaza’ brands

The commercial court in Vadodara last week has ruled in favour of Amul Dairy which has filed a case against Shri Shakti Dairy and Kuldeep Enterprises, the authorities that were responsible for buying, selling and advertising of products whose name were matching to Amul’s original products.

In 1998 Amul Dairy and the apex marketing body of all district dairy unions of Gujarat, Gujarat Cooperative Milk Marketing Federation Limited (GCMMF) have found that Shri Shakti Dairy is indulged in selling and manufacturing of items which named as ‘Anul Taaza’ and ‘Anul Shakti’. Notably, the name resembles too Amul’s well-known brands ‘Amul Shakti’ and ‘Amul Taaza’.

For the correction, Amul firstly has sent notice to the alleged firms. In return, Shri Shakti Dairy and Kuldeep Enterprises have claimed that there is no chance of confusion to customers as the names are phonetically different and the firms continually sell the items with same rhymings. For justice Amul moved to the district court of Nadiad then, the case further went in the hand of Vadodara’s new commercial court. There GCMMF’s advocate highlighted that the product is getting sold at village areas where the customer gets confused with the names and found difficulties in differentiating between both of the names. The verdict was then announced in the favour of Amul there, according to which Shri Shakti Dairy and its marketing firm along with their agents, dealers and distributors will have to stop manufacturing, processing, marketing and packing milk under their labels.
