'Article 370 disputed, 371 can be a way out': Muzaffar Hussain

Jammu: Former Jammu and Kashmir Deputy Chief Minister Muzaffar Hussain Baig held an all party meeting last Thursday. During the meeting, he said, "Some special powers can be given to the citizens of Jammu and Kashmir by amending Article 371. Article 371 in the Constitution provides special provisions to several States including north eastern states like Nagaland, Mizoram and Arunachal Pradesh". Let us tell you that former deputy CM Muzaffar Hussain Baig was earlier with pdp. He recently suggested that "The challenge of repealing Article 370 comes in the backdrop of acceptance by some parties, including the National Conference. It would be foolish to expect this Government that Article 370 will be restored in Jammu and Kashmir".

In fact, Article 370 of the Constitution provided a mechanism for jammu and kashmir's relations with the Union of India. The Supreme Court is currently hearing petitions challenging the Reorganisation of Jammu and Kashmir Act, 2019 and Parliament repealing Article 370. Let us tell all of you that Two days after attending the meeting chaired by the Prime Minister, Muzaffar Baig issued a statement. In it, he said, "Permanent residents of Jammu and Kashmir were given domicile rights under (Article 35A). Article 35A comes from Article 370, which was imposed in 1954 following an order of a President. It empowers the Jammu and Kashmir legislature to define the permanent residents of the state and their special rights and privileges".

At the same time, he said, "The middle path has also been explored in this rope of deadlock. This formula may be to introduce special provisions of Article 371 in parts of Jammu and Kashmir instead of the withdrawal of Article 370. Article 371 is applicable in 11 States of the country including Himachal, Gujarat, Uttarakhand. "Essence of Article 35A" can be taken care of by adding an additional clause to Article 371 regarding exclusive rights of state subjects.
