Recently concerning authority ''The Animal Welfare Board of India'' has written to the director of the Department of Animal Husbandry and Veterinary Services (AHVS) in Kolkata, as well as the member secretary of the Calcutta Society for the Prevention of Cruelty to Animals (CSPCA), requesting that the animals from the Ajanta Circus be seized and rehabilitated as soon as possible.

The order was issued after Ethical Treatment of Animals (PETA) India filed a complaint saying that the circus was performing with animals without a certificate for performing animals (PARC). The AWBI shut down the circus's PARC on January 17, but the animals were supposedly still performed.

The AWBI, which is the given a prescription authority under the Prevention of Cruelty to Animals (PCA) Act, 1960 and restricts the use of animals for performance this season in the country, has cancelled Ajanta Circus' PARC after the circus failed to respond to a show-cause notice issued on December 1, 2020, and reminders sent out on January 13 and August 24, 2021.

The AWBI had issued a show-cause notice to the circus for violating the Performing Animals (Registration) Rules, 2001, by failing to notify the AWBI before moving to Kishanganj, Bihar, and for concealing the location of animals to avoid an inspection, as well as for violating Section 26 of the PCA Act. On January 3, 2020, the AWBI last received a monthly report from the circus.

The circus is currently stationed at Sinthi More Mela Ground in Baranagar, Kolkata, where they are allegedly performing daily with three horses, nine dogs, two macaws, and seven cockatoos, according to the complaint.
