KOLKATA: The West Bengal government has decided to appeal the Calcutta High Court division bench's ruling that the "Duare Ration" (rations delivered to doorsteps) programme is unlawful to the Supreme Court.

When finding the "Duare Ration project" unconstitutional on Wednesday, a division bench of Justice Chittaranjan Das and Justice Aniruddha Roy noted that the aforementioned scheme was against the National Food Security Act, 2013 and should therefore be halted.

Under the strict condition of secrecy, a senior official from the state law department identified some of the issues that should be brought up before the Supreme Court.

"A group of fair price shop dealers moved the Justice Amrita Sinha-led single-judge bench of the then-Calcutta High Court many months after the project's inception. The petition demanding the cancellation of the "Duare Ration system" was then dismissed by that single-judge panel. The petition was then dismissed on the grounds that Justice Sinha herself provided. The reasons Justice Sinha provided at the Supreme Court will be highlighted by our attorneys as they evaluate that ruling "added the official.

The second point that the state administration wants to make is that since the "Duare Ration plan" has already been started with millions of rupees spent, scrapping it in the middle will result in a loss of all of that money.

Legal experts believe there is minimal chance of obtaining a reverse ruling at the supreme court given the division bench of the Calcutta High Court's finding that the project violates the National Food Security Act, 2013, however "

Keep in mind that the Arvind Kejriwal-led Delhi government made a comparable effort to guarantee foodgrain supply through the public distribution system at the doorsteps of the state's citizens. However, the plan had to be scrapped as a result of a court order on an analogous legal basis "said Kaushik Gupta, a senior attorney of the Calcutta High Court.
