Supreme Court orders MP panchayat elections not be held on OBC reservation

The Supreme Court has issued its order on the Madhya Pradesh Panchayat elections. The case is scheduled for further hearing on January 27. The Supreme Court has issued a direction to the MP State Election Commission asking it not to conduct panchayat elections on OBC reservation basis. Panchayat elections have also been canceled for not complying with the directions. Earlier, the MP High Court has refused to hear early hearing, urgent hearing on petitions filed on delimitation and reservation under panchayat elections to be held in Madhya Pradesh. The petitioners have requested an early hearing on the matter on Thursday.

A bench of Chief Justice Ravi Malimath and Justice Vijay Shukla made it clear that the case is going to be heard next after the winter vacation. While the next date of hearing on another petition filed by Damoh resident Dr. Jaya Thakur through advocate Varun Thakur citing the Supreme Court order on Thursday has been fixed as December 21 before the winter vacation. The petition has accused the Madhya Pradesh government of trying to conduct panchayat elections in an arbitrary manner. It has been said that the State Government has deliberately made constitutional errors, which is making the Panchayat election case more complicated than solved.

It has been found that a petition challenging the ordinance issued by the state government for panchayat elections was initiated in the Supreme Court on Wednesday. The Supreme Court has categorically stated that two courts cannot be included in a case. The petitioners should take their stand in the High Court. It may be recalled that on December 9, the High Court had refused to interfere in the case and the government's ordinance is not going to be promulgated. After which the petitioners moved to the Supreme Court. The High Court had said that the court does not have the right to interfere in the constitution after the notification of elections is issued under the provisions contained in Article 243 (O).
