Nagpur: The Nagpur Bench of Bombay High Court has recently once again pronounced a decision that has surprised everyone. Actually, the decision given by the court in the rape case will be the reverse of anyone's expectation. Recently, a single bench of the High Court acquitted a young man accused of raping a minor girl. Indeed, the Nagpur High Court bench recently said that "a 15-year-old girl cannot be raped without a scuffle." Not only this but the High Court bench has also said, 'It does not seem possible for a single young man to press the victim's mouth, take off his or her clothes and forcefully rape without any scuffle.'
This decision has been pronounced by Justice Pushpa Ganediwala of Nagpur Bench of Bombay High Court. He said in his decision, 'If it was a case of forced rape, it would have been a scuffle. Medical evidence is also not in favor of the girl's allegations, as no injuries or traces of any coercion were found in the medical report. At the same time, during the hearing, Justice Ganediwala also said that 'The girl had stated her age as 18 years in the trial court, but her mother had written the girl's age as 15 years in the FIR.' At the same time, Justice also said, 'It is almost impossible for a single man to close the victim's mouth and take off her clothes and rape her without any scuffle. The evidence found after the medical examination is also not in favor of the victim's case.
What's the matter- On July 6, 2013, the accused youth was accused of rape by the girl's family members. On March 14, 2019, 26-year-old Suraj Ka Sarkar, an accused, was convicted of raping a minor. After that, the sessions court convicted Suraj and sentenced him to 10 years of rigorous imprisonment. The accused then petitioned the High Court and claimed in his plea that 'he and the victim were in mutual consent'. Not only this but he also told that 'when the mother of the girl came to know about this, she filed a case against him.'
