Mumbai: Former Maharashtra cabinet minister Nawab Malik has received a disappointment from the Bombay High Court. The court has flatly refused to hear his bail plea immediately. No immediate hearing on his petition is due to being admitted to a private hospital of his choice for the last 6 months. Hearing Malik's plea, Justice MS Karnik said that there are other accused who need urgent hearings under medical emergency.

While hearing the case of Nationalist Congress Party (NCP) leader Nawab Malik's plea, the justice asked the Enforcement Directorate (ED) to file a reply to the bail plea. The judge has said that in case of a medical emergency, Nawab Malik can go to court even during the Christmas holidays. The hearing of the case has been adjourned till January 6. Additional Solicitor General (ASG) Anil Singh, appearing for the probe agency, told the court that it has become a regular practice that bail applications are filed on the merits of the case. This work is also done on the basis of health. However, Nawab Malik's lawyers Amit Desai and Kushal Mor said that Malik is living on one kidney as the other kidney has stopped working.

The judge told Nawab Malik's counsel that he would grant the concession only when he was fully satisfied about the medical condition. The judge said that hearing on the petition will be taken seriously only when there is no arrangement for treatment. The ASG told the court that Nawab Malik is admitted to the hospital of his choice from May 2022. After listening to the ASG's argument, Justice asked Nawab Malik that you are admitted to a private hospital. If you are there, this petition will be heard later.

Malik's counsel alleged that the ED was pressing for his discharge. The treatment that was to be given to Nawab Malik was not available in the government hospital. This was the only reason for admission to a private hospital. Malik's lawyer said that his 63-year-old client (Nawab Malik) needed a kidney transplant. During the hearing, the ASG told the court that Nawab Malik had refused to get examined by the doctors of the state government hospital committee. However, Malik's lawyer said that he never objected to this. Malik's medical condition is continuously deteriorating.
