Mumbai: The Bombay High Court has recently said something on a case that it has become a part of the discussions. The Bombay High Court said that a hand on the minor girl's chest cannot be treated as a sexual assault. The Bombay High Court has also said that as per the law to protect children from sexual offences (POCSO Act), unless the skin of two different people is touched, the offence cannot be treated.

This is what has been said about the incident with a minor girl. In the Nagpur Bench of the High Court, Justice Pushpa Gandiwala has pronounced the verdict in the case relating to a 12-year-old girl. The order said, "As per POCSO law, there should be a touch of skin from the skin motivated by sexual assault, only then it falls under the category of crime. " The case was of December 2016 and in this case, the 39-year-old accused had called the girl home on the pretext of giving her food.

He had tampered with the girl there. During that, the police had filed the case under the POCSO Act. Finally, the sessions court sentenced the man to three years of imprisonment as guilty. The order was challenged by the guilty in the High Court and now the High Court in its order said, "There is no offence under the POCSO Act but there was an attempt to dissolve the modesty of the child. The High Court now said that there was an offence under section 354 of the EPC, so the convict Satish is relieved of imprisonment for three years under the POCSO Act but will continue to be sentenced to one-year imprisonment under section 354. Further, the High Court has also said, "If the case is to be run under the POCSO Act, there is clear evidence. On the basis of that, the punishment will be announced. If the chest of a woman or a minor girl is touched with the wrong intention, it becomes a case of breach of modesty. '
