Canada Launches Pilot Program to Simplify Hiring of Temporary Foreign Workers

Canada has introduced a pilot program to address the shortage of temporary foreign workers, aiming to streamline the process and provide eligibility criteria for interested parties. The Recognized Employer Pilot, set to launch in September, is part of the Temporary Foreign Worker Program (TFWP), with the primary goal of simplifying the hiring process for employers who adhere to regulations consistently. This move is expected to alleviate administrative burdens associated with hiring foreign workers.

The pilot initiative acknowledges employers who have consistently followed TFWP regulations in the past. By identifying such employers, the program intends to make procedures more efficient and expedite the recruitment of foreign workers. This strategy is especially targeted at bridging labor gaps in specific industries or geographic regions facing shortages.

In order to facilitate the hiring of foreign workers, the Canadian Recruitment and Employment Program (REP) has been introduced. This program extends the validity of the Labor Market Impact Assessment (LMIA) to 36 months and streamlines the application process. LMIA ensures that job positions cannot be filled by local workers, and REP eases the staffing planning process for employers by reducing the frequency of LMIA applications over a three-year span. Additionally, employers who meet the program's criteria will receive recognition on the Job Bank platform, enhancing their attractiveness to potential hires. This initiative is designed to strike a balance between labor market requirements and the protection of Canadian workers' interests.

To qualify for the Recruitment and Employment Pathway (REP), which is a part of the new Canadian immigration program, employers must have obtained three favorable LMIAs for in-demand occupations according to the Canadian Occupational Projection System (COPS) data within the last five years. This pathway is being introduced in two phases: starting from September 2023, primary agriculture employers can apply, while other employers will be able to apply from January 2024. The application window will close by September 2024.

Participants in the REP will benefit from a simplified application process for LMIA applications related to COPS-listed positions. This will result in reduced interactions with the Department of Employment and Social Development (ESDC) due to streamlined application forms and processes.
