New Delhi: The Union Home Secretary's affidavit on Tuesday could not be filed in the Supreme Court on a plea filed by gangster Abu Salem challenging the conviction awarded in the Mumbai serial blasts and the extortion case against Pradeep Jain. Hearing the case on Tuesday, the court directed the central government to take oral information from Union Home Secretary Ajay Bhalla and take them to the court.
In the last hearing, the court had asked whether the Government of India would still abide by the assurance given by the then Deputy Prime Minister of India at the time of Salem's extradition from the Union Home Secretary. The court had asked the Union Home Ministry to file a reply on the issue. Gangster Abu Salem, who is serving a life sentence, has filed a petition in the top court. The petition seeks to commute the sentence. Abu Salem has said that he has been illegally kept in India. The Indian government should extradite him to Portugal.
What's the whole matter?
At the time of extradition from Portugal, there was an assurance from the Indian government that no more than 25 years of punishment would be awarded in any case. Abu Salem is demanding a reduction in the sentence citing the same promise. Filing a petition in the top court, Salem said he has been sentenced to life imprisonment. However, an affidavit has been filed on behalf of the CBI stating that it is not obliged to accept the assurance given in 2002. While hearing the matter, the top court had recently ordered the home secretary to file an affidavit asking whether the government would not accept international commitments. The impact will be on the international level, with far-reaching consequences. In the future also, you will have to extradite someone and bring them to India.
