Central government files affidavit in Delhi HC over same sex marriage

New Delhi: The Central Government opposed the similar sex marriage in the Delhi High Court, stating that marriage in India is not a mere union of two people, but a practice of social concern between biological men and women. The government also said that judicial intervention would completely destroy the delicate balance of individual laws.

The Central Government said that if any court intervenes in this, its decision will disqualify all statutory provisions in the interpretation of a man who is considered to be a husband and a woman who is considered a wife. Citing a verdict of the apex court, the central government said that it had only weakened a particular behavior and not legalized it. It states that two people get social recognition in marriage, which is governed by no private law or codified statutory laws.

The Central Government stated in its affidavit, "The acceptance of marriage between two people of the same sex is neither recognized nor accepted in any individual laws or any statutory laws." The affidavit filed in response states that the question whether such a relationship should be formally allowed through the legal recognition of marriage is essentially a question to be decided by the legislature and never judicial favors.
