E-cigarette bill introduced in Lok Sabha, there is provision for punishment without warrant

New Delhi: Union Health and Family Welfare Minister Dr. Harsh Vardhan today introduced a bill banning electronic cigarettes (Electronic Cigarette Prohibition Bill 2019) in the lower house of Parliament. In this bill, there is a provision for raids and confiscation against e-cigarettes without warrants. If e-cigarette is found with someone, then 1-3 years imprisonment and fine of Rs 1-5 lakh can also be imposed.

The bill prohibits the production, production, import, export, buying, selling, storage of electronic cigarettes and its advertisements. According to an ordinance issued in September by the Ministry of Home Affairs, the states had asked to ban e-cigarettes. After sending a letter to the Principal Secretary and Director General of Police of all the states and union territories, the Ministry of Home Affairs was asked to ban it due to its fatal effects on health.

The Electronic Cigarettes Ordinance 2019 relating to banning it was implemented on 18 September. Accordingly, the production, sale and purchase of products were banned. Sections 4 and 5 of the ordinance provide for banning e-cigarettes. At the same time, the provisions of punishment related to its violation are present in sections 7 and 8.
