The government said on Monday that it is taking all necessary steps to increase the capacity of the National Company Law Tribunal (NCLT), but that no new benches or the National Company Law Appellate Tribunal are being planned at this time (NCLAT).
Minister of State for Corporate Affairs Rao Inderjit Singh stated in a written reply to the Lok Sabha that the NCLT and NCLAT benches are being built in stages based on workload and other reasons. So far, NCLT has one principal bench and 15 other benches, whereas NCLAT has one principal bench and one other bench. "Aside from increasing the number of benches, the government is taking all necessary steps to increase the capacity of the NCLT," he said, citing multiple courts at overburdened benches, the appointment of members on a regular basis to fill vacancies, the implementation of the e-court project, the provision of necessary infrastructure, and regular colloquiums for members.
He further stated that no proposal to establish a new NCLT or NCLAT bench is currently being considered. According to information from the tribunal, there were 21,089 cases pending with NCLT benches as of January 31, 2022, comprising 13,188 IBC cases, 1,107 M&A cases, and 6,794 other matters.
