NEW DELHI: The Congress on Monday opposed the government's CrPC amendment bill in the Lok Sabha, claiming that it violates Article 21 and is beyond the government's legislative competence.
"The Criminal Procedure (Identification) Bill 2022, which is a derogation of Article 20 sub article 3 and Article 21 of the Indian Constitution, highlights that the bill is beyond the legislative competence of the House and goes against our citizens' fundamental rights," said Congress MP Manish Tewari. In light of the Supreme Court's rulings, he claims that an accused cannot be forced to testify against oneself.
The government, on the other hand, dismissed the complaints, and the bill was introduced following a vote division in which the opposition was defeated.
The law was enacted in 1920 and is 102 years old, said Union Minister of State for Home Affairs Ajay Mishra Teni, and it has to be modified in the interest of the law enforcement agency. The bill was submitted to a vote for introduction, and the government received 120 votes to the opposition's 58 votes.
