New Delhi: The Supreme Court on Friday (Feb 3) refused to hear the bail plea of ​​former Congress councilor Balwan Khokhar, convicted in the 1984 anti-Sikh riots case. The Supreme Court has said that this is not a case where you file a bail application within 9 years. Last month, on January 3, the apex court summoned the response of the CBI on the bail plea of ​​Congress leader Balwan Khokhar. A bench of Justice SK Kaul and Justice Abhay S Oka had taken note of the fact that Khokhar, apart from being 50 percent disabled, has so far spent 8 years and 10 months in prison in the case.

Earlier in May 2020, the Supreme Court had refused to grant interim bail or parole to former Congress leader Sajjan Kumar on health grounds. Sajjan Kumar and Balwan Khokhar have been imprisoned in Tihar Jail since their conviction in the case on 17 December 2018 by the Delhi High Court. Khokhar's life sentence was upheld by the Delhi High Court in 2018.

Sajjan Kumar was sentenced to life imprisonment in November 1984, overturning the lower court's April 2013 verdict in the case of killing 5 Sikhs in Rajnagar, Palam. The decision of the Lower Court was upheld in which Balwan Khokhar, Captain Bhagmal, Girdhari Lal, former MLA Mahendra Yadav, and Krishna Khokhar were sentenced. The lower court had sentenced Balwan Khokhar, Girdhari Lal, and Bhagmal to life imprisonment.

The court also found him guilty of criminal conspiracy to burn down the houses of Sikh families and a gurdwara in the area during the riots. In 2013, the trial court sentenced Balwan Khokhar, Bhagmal, and Lal to life imprisonment and Yadav and Kishan Khokhar to three years in jail. After the decision of the High Court, the sentence of Yadav and Kishan Khokhar has been increased to 10 years.
