UP’s law on cow slaughter being misused against the innocent: Allahabad HC

The Allahabad High Court has expressed concern over the use of the provisions of the Prevention of Cow Slaughter Act 1955 last Monday. In fact, the court recently said, "This law is being misused to entrap innocent people.“Whenever any meat is recovered, it is normally shown as cow meat [beef] without getting it examined or analysed by the forensic laboratory." He further said, "The provisions of the Uttar Pradesh Prevention of Cow Slaughter Act 1955 are being misused and sent to jail. '

Further, the High Court order also says, "The prevention of cow slaughter law against innocent persons is being misused. Whenever a meat is recovered, it is normally shown as cow's meat (beef), without its examination or analysis by the forensic laboratory. In most cases, meat is not sent for analysis. Persons have been jailed for an offence which may not have been committed and which are trial by a first class magistrate with a maximum sentence of up to 7 years. In fact, the High Court, in its order issued on 19th October, said, "The cows which have become old or do not give milk also need to be taken care of. Because the cow owners leave them at this stage. If the government brings a prevention of cow slaughter law to protect the cow dynasty, it should also think about it. '

In fact, the High Court has expressed concern over the poor condition of govansh. Expressing concern, he said, "Goshalas do not accept milk-giving cows and old cows. “Moreover, cows and cattle on the road are menace to the traffic and number of deaths have been reported due to them. In the rural areas cattle owners who are unable to feed their livestock, abandon them. They cannot be transported outside the state for fear of locals and police. There are no pastures now. Thus, these animals wander here and there destroying the crops.” 

Further, the court also said that ' cows, whether on roads or in the fields, abandoning them or being abandoned by the owners, adversely affect the society. If Uttar Pradesh wants to enforce the Prevention of Cow Slaughter Act under its spirit, action should be taken to keep them in the cow shelter or with the owners. '
