Delhi court grants bail to AAP MLA Somnath Bharti

New Delhi: A Delhi court on Thursday stayed Malaviya Nagar Aam Aadmi Party (AAP) MLA Somnath Bharti in 2016 for 2 years imprisonment for assaulting AIIMS employees and damaging government property. The court, while issuing a notice to the prosecution, pending the outcome of its appeal, has also sought an answer in the matter.

The court's decision to suspend the sentence has given major relief to MLA Somnath Bharti. Somnath will remain MLA from Malviya Nagar for the time being. He was sentenced to two years of imprisonment in this case. Under the Representation of the People Act, an MLA is disqualified due to being imprisoned for at least two years. Somnath would have to leave the post of MLA due to the punishment and Malviya Nagar seat would be vacant, but now after the suspension of the sentence by the court, Somnath Bharti has again become the MLA of Malviya Nagar.

On the other hand, Special Judge Vikas Dhul accepted the appeal filed by Somnath Bharti and said that this appeal will take time to settle, in such a case, they stop the punishment. The court has granted bail on furnishing a personal bond of 20 thousand and a surety of the same amount with a stay on the punishment.
