Delhi court:NO stay on defamation case besides Kejriwal

May 20,2016: Ram Jethmalani,the senior advocate, showing for Delhi CM Arvind Kejriwal in the defamation case beside Union FM Arun Jaitley, appealed for a passing adjournment of trial that was deprived of by the chief metropolitan magistrate .

Senior Advocate said, "Adjourn the matter, so that I can approach the High Court in this regard... I don't want to face both the cases simultaneously,"

Chief Metropolitan Magistrate (CMM) Sumit Das stated, "In my opinion the civil suit for damages on account for defamation and criminal defamation case both stands on different footing and can be tried simultaneously."

Finance Minister has smashed Kejriwal and five other members of the AAP party in a criminal defamation suit and a civil civil defamation case. Ashutosh Bhardwaj, Kumar Vishwas, Deepak Bajpai, Sanjay Singh and Raghav Chadha are also named in the complaint.

As per the court said, "In the larger interest of justice and to cut short the controversy and to enable the accused to address arguments on the point of notice/to avoid prejudice to the accused, let another set of documents complete in all respects be supplied,"

Responding to the charges, Siddharth Luthra,”showing for Jaitley offered that in so far as the documents are worried, two sets of copies have already been supplied, and Phoolka's plea was nothing but a tactic to seek more time or to "protract the trial and delay the case."

The next hearing date will be on July 16, set by the CMM Das.
