New Delhi: The Delhi High Court on Wednesday refused to hear a PIL seeking removal of parts that NCERT had donated to repair temples during their rule, seeking removal of parts from their Class XII history book. However, the court did admit that the Mughal rulers had oppressed non-Muslims and forced them to convert to the Muslim religion. A bench of Chief Justice DN Patel and Justice Jyoti Singh dismissed the petition saying that the petitioners, who claim to be their own hardworking and honest students, want the court to review the policies of the Mughal rulers in their own way.
The court said that you are saying that you have a problem that Shah Jahan and Aurangzeb did not have any such policy to give grants for temple repairs etc. Do you want us to decide on the policies of Shah Jahan and Aurangzeb? Will the High Court decide all this now? The court said the petition was wasting judicial time and also asked the petitioner to withdraw the petition unconditionally. In fact, the petition says, "Paragraph 2 to page 234 of the book "Part 2 of the Theme in Indian History" was published without any valid source and was included only to glorify the reigns of Mughal Emperorshah Jahan and Aurangzeb.''
On this, the High Court said that it is a well-known fact that most Mughal emperors had collected huge taxes from Hindus on religious ceremonies and pilgrimage demonstrations. It is not news that even the Mughal emperors forced non-Muslim people to convert to the Islamic religion. The petitioners claimed that they had also filed an RTI application before the public information officer of the NCERT stating that their files did not contain any information regarding the "source of NCERT's conclusion for the Mughals".
