Delhi High Court's verdict, wife's right on husband's 30 per cent salary

New Delhi: Delhi High Court has said that one-third of the husband's total salary should be paid to the wife as alimony. The court said the formula for income sharing is prescribed. The rule is that if no one else is dependent, two parts of the husband's total salary will remain with the spouse and a part of the wife. The court passed the verdict on the petitioner's application and directed that the woman get 30 per cent share from her husband's salary.

In a case, a woman, was married on May 7, 2006. Her husband is an inspector in CISF. On October 15, 2006, the two were separated. After that, the woman applied for alimony. The alimony of the woman was prescribed on 21st February 2008. Her husband was instructed to give 30 per cent of his total salary to his wife. The verdict was challenged by the woman's husband. The trial court reduced the alimony from 30 per cent to 15 per cent of the salary. The verdict was then challenged by the woman in the Delhi High Court.

The woman's lawyer argued that the trial court made alimony 15 per cent and did not tell any concrete reasons. On the other hand, the husband's side argued to tell the detail of the woman's account and clarify which sources the money came from in the account. The woman told the account detail that her father had paid her for the expenses. In his judgement, High Court judge Sanjeev Sachdeva said that it is decided that the woman was prescribed a 30 per cent alimony of her husband's total salary under the alimony which was released on 21st February 2008.
