Delhi High Court Dismisses Petition Challenging Nitish Kumar's Election as JDU President

Patna: The Delhi High Court has dismissed a petition filed by Govind Yadav, a former Janata Dal United (JDU) member, challenging the election of Nitish Kumar as the party president. Yadav had argued that Kumar's election breached the party’s constitution and violated its internal democracy.

Justice Purushaindra Kumar Kaurav ruled that there was no compelling reason to interfere with the election outcome. The court highlighted that the Election Commission of India had already recognized Nitish Kumar’s faction as the legitimate JDU, granting them the entitlement to use the party's reserved symbol, the Arrow, as the officially recognized state symbol in Bihar. Yadav's petition sought to annul the internal elections conducted by JDU in 2016, 2019, and 2022, alleging they were fraudulent. The High Court noted that the Nitish Kumar faction had demonstrated overwhelming support within both the legislative wing and the National Council of JDU, which are the apex organizational bodies of the party. The court also referenced the Election Commission’s interim orders that validated Kumar’s faction as the legitimate JDU.

The court rejected Yadav’s claim based on a September 20, 2017, letter from the rival faction, which had designated Chhotu Bhai Amarsangh Vasava as acting party president. The court found this letter lacked merit compared to the final orders from the Election Commission, which recognized Kumar's faction as the legitimate party leadership.
