Delhi riots: 'Umar Khalid's speech was provocative...', HC refuses to grant bail

New Delhi: The Delhi High Court has termed the speech of Former Jawaharlal Nehru University (JNU) student Umar Khalid, who was arrested under UAPA in connection with the Delhi riots case, in Amravati as provocative and objectionable. Khalid, the main accused in the 2020 Delhi riots, has rejected the bail plea of Justice Siddharth Mridul and Justice Rajnish Bhatnagar.

The court said, "Isn't it wrong to say that when your ancestors were brokering the British? Such provocative statements cannot be made citing freedom of expression. It is not allowed in a democracy. The court asked, "Don't you think these expressions used in the speech are provocative?" This is not the first time you have said that in your speech. You said it at least five times. It is almost as if India's freedom struggle was fought by only one community. The court asked whether Gandhiji or Shaheed Bhagat Singh ji had ever used this language. The Delhi High Court also read out a part of Khalid's speech. The court then told Umar Khalid's lawyer Trideep Paes that it was not surprising to see the statement as to why the police had registered an FIR in it.  

Taking a strong stand on Paes's plea, the court questioned whether the right to freedom of expression amounts to making unpleasant speeches. which is an offence punishable under 153A and 153B of IPC. When the court asked what are the charges against Khalid. In response, Trideep Paes said Khalid has been accused of conspiracy, but he was not present in the city at that time. The court, however, said that prima facie the court can say that the speech made by Khalid is not acceptable. The court issued notice to the Delhi Police on Khalid's bail plea and directed it to file a reply within three days. The next hearing on the petition will be on April 27.
