Will same-sex couples get recognition for marriage? Delhi HC hearing today

New Delhi: The Delhi High Court will hear petitions seeking legal recognition of same-sex couples today. The case was earlier heard on May 24 when Solicitor General Tushar Mehta sought a temporary stay due to the current corona virus situation. A bench of Justices Rajiv Sahai Endlaw and C Harishankar, who were hearing the case, then adjourned the matter for July 6.

The petitioners say that members of the LGBT community are compelled to suppress their feelings of marrying a person of their choice. In arguments, he also said that it is discriminatory to refuse the option of marrying the LGBT community and makes them second-class citizens. On the other hand, the Central Government is opposing the matter saying that the petitions are unstable and wrong and the Centre has demanded their dismissal. The Centre has argued that marriage is essentially a socially recognized association of two people, governed either by unaffiliated personal laws or codified statutory laws.

In response to the petitions, the Delhi High Court had earlier told that the acceptance of the institution of marriage between two persons of the same sex is neither recognized nor accepted in any unaffiliated personal laws or any codified legal laws. The petitioners are demanding recognition under the Hindu Marriage Act, the Special Marriage Act and the Foreign Marriage Act.
