Maharashtra: Asking for money from a wife is not wrong, the Nagpur bench of the Bombay High Court left a man who was accused of his wife's suicide after nine years of marriage. In this case, the Nagpur bench of Bombay High Court has said that 'it cannot be considered harassment as per Section 498A of IPC'. According to reports, the evidence related to this case is in relation to a quarrel between husband and wife where the husband used to kill his wife for money. In such a situation, Justice Pushpa Ganediwala, while granting permission to enter the plea, has said that 'demanding money is not a crime'.
What is the matter- In this case the marriage between the couple was canceled in the year 1995. On 12 November 2004, his wife committed suicide. The victim's father then filed a complaint at the Darbha police station. In this complaint, it was alleged that, 'Her daughter was harassed by her husband and in-laws for not getting dowry'. On April 2, 2008, the sessions court convicted Prashant Jare (victim's husband) under sections 306 (kidnapping for suicide) and 498A (a relative of a woman's husband subject to cruelty) of the IPC. For the first offense, the accused was sentenced to three years behind and the second to one year. The same decision was challenged by the accused in HC.
In this way, Justice Pushpa Ganediwala said that the petitioner Prashant Jare was allowed to be acquitted earlier this month. Now the family members accused in the case were acquitted by the court. In fact, Justice Pushpa Ganediwala said, "The victim's minor daughter was questioned by the police as she was present when the incident took place and her mother was beaten up by Jere and forced to consume poison."
