New Delhi: The Saket district court has issued a notice seeking a response from the government on a plea claiming the Quwwat-ul-Islam mosque built by demolishing 27 Hindu and Jain temples in the Qutub Minar complex. ADJ Pooja Talwar, after hearing the arguments of the petitioner's counsel in the case, issued notices to the Central government's Ministry of Culture, Director General of archaeological survey of India and Delhi Circle asking them to respond. The petition has been filed on behalf of Lord Vishnu and Jain deities whose temples were demolished.
Vishnu Shankar Jain, the lawyer for Jain deities and Lord Vishnu, has argued in the court that there is no dispute in the matter that the temples were demolished. So there is no need to prove it. We have suffered for more than 800 years. Now they are asking for the right to worship, which is our fundamental right. According to Section 18 of the ASI Act, 1958, the right to worship can be given even in protected monuments.
During the last hearing, on December 24, 2020, the court had directed the petitioner to explain what is the justification for filing the petition in the capacity of a devotee. The court had asked whether the court can order the formation of the trust. During the hearing, the petitioner's lawyer Harishankar Jain had told the court that there was no dispute in the case that the temples were demolished. Jain said that prayers have not been offered there for the last 800 years. It has not been used as a mosque.
