Lucknow: The Uttar Pradesh Assembly on Thursday (September 22, 2022) passed a bill amending the UP Recovery of Damage to Public and Private Property Act 2020. According to the bill, damage to property during strikes, bandhs, riots and protests will be compensated from miscreants and protesters. To compensate the rioters, the Yogi Adityanath government of the state is going to make the law more stringent as well as increase the powers of claim tribunals.
Along with this, the state government has made several important recommendations to clamp down on miscreants who damage government and private properties. Under which the expenses of the police and administration engaged in handling the incident and maintaining law and order will also be added with the compensation of public or private property during the violence. The Uttar Pradesh Recovery of Damage to Public and Private Property (Amendment) Bill, 2022, allows the transfer of proceedings to claim authorities on the basis of where it is. Apart from this, the powers of the claimed authority will also be increased. The amendment gives the tribunal judicial discretionary power to condone the delay in filing the claim petition, take suo motu cognisance of the matter and provide compensation to those injured during strikes, bandhs, riots, and public ruckus.
Now in case of violence during a demonstration or dharna, those who organized that event will also be charged. Those who incite nuisance will also be booked. A petition can be submitted to the claims authority for three years instead of three months. Along with this, preparations are also underway to empower the claims authority to give additional time to the petitioner.
